«Na primeira instância, o Tribunal Judicial de Setúbal aplicara uma pena de um ano e meio de prisão, com pena suspensa, condenando o arguido por um crime de violência doméstica.
A suspensão da pena ficava dependente do pagamento de 8.000 euros à vítima.
O arguido recorreu e o Tribunal da Relação decidiu condená-lo apenas por um crime de ofensa à integridade física simples, em 800 euros de multa, e fixou em 500 euros o valor a pagar à mulher, por danos não patrimoniais.
